Former Yates County tax appraiser John Nicolo has been in the Yates County Jail since his conviction in May but was taken to the hospital at 2 a.m. Wednesday, June 25, according to Yates County Sheriff Ron Spike.



"He was transported to a physician and then to a hospital outside Yates County," he said. Spike would not reveal what hospital he was admitted to or the medical condition Nicolo is suffering from.



Spike says the Yates County Sheriff's Department turned custody over to United States Marshals around noon Wednesday. Once Nicolo is released, he may come back to Yates County Jail, but Spike can't say for sure. That will be up to U.S. Marshalls.



The reason he came to Yates County Jail in the first place is related to the fact that he is from Yates County, Spike said. The federal officials "knew we had beds open and they called to see if we could take him."

Nicolo, who has homes in Penn Yan and Florida, was convicted of conspiring with former Greece town assessor Charles Schwab and former Kodak tax accountants Mark Camarata and David Finnman to scam area companies, including Kodak.



Schwab would raise assessments of Kodak property so that Finnman and, later, his replacement, Camarata, would have the imaging company hire Nicolo to negotiate a lower assessment. The prosecution contends Nicolo would split his earnings, which tallied in the millions, with Schwab, Finnman and Camarata as part of the kickback scheme. IBM, Rochester Gas & Electric, Global Crossing and ITT Industries, and the towns of Gates, Greece and Henrietta also were affected by the scheme.



Nicolo has had health issues in the past. He argued for a change in venue for his trial because he claimed he couldn't get a fair one in Rochester and because of health reasons. But the trial stayed here.



Besides Nicolo, his wife, Constance Roeder was also convicted of their participation in the scheme in May. Camarata pled guilty, as did Schwab, who is scheduled to be sentenced Friday, June 27
